As I understand it the argument presented by Holder has been he and his Justice Department knew nothing about Fast and Furious.
If that is true then how does releasing documents to prove it involve Executive Privilege? If as claimed no one at Justice knew about the Program then how does releasing documents to prove that jeopardize confidential communications or decisions between the Executive?
The entire argument by the White House and justice is they did NOT KNOW. If true then no records they have can implicate them and thus can not implicate executive decisions or policies.
