I think it's their right to hire or not hire who ever they want for what ever reason.

Ultimately this is about saving money on the company health plan and any other benefits (e.g. Life Insurance) that the employer provides.
They could stop providing these to all employees.
But that really isn't fair to those that are not degenerates.

I have worked with fat lazy people and I have worked with smokers, I would rather work with a smoker.

That's actually not true. It depends on if the handicap interferes with the required skills of the job. Since smokers require more frequent breaks and are out sick more often due to smoking related illness their "handicap" does interfere with just about any job duties.Hiring a smoker is not as cost effective as hiring a similarly qualified non smoker.
