You are confused, the stunt where the soldier refused to deploy because he thought the president was born in Kenya had nothing to do with the 1st amendment. A soldier who has a complaint with the chain of command must go through military channels and has no access to civilian courts for that complaint.

Hey stupid. . There is no law passed by congress that says a soldier cannot sue in a civil court. The courts have tried to rewrite the law to say soldiers have no such right but the constitution says courts can't write laws. THINK
The UCMJ is clear on the procedure to challenge unlawful orders and the civilian courts have no jurisdiction.

Actually, in the military, you DO have First Amendment rights, but in order to exercise them, you have to check with the PAO (Public Affairs Officer) first to check if you can go in uniform or not. If it is a partisan event, you have to go in civilian clothes. If it is a general event (Memorial day and the like), in certain cases you can go in uniform.

And no...............the military is NOT supposed to keep their mouth shut and follow orders. In Navy Rights and Responsibilities (required annual classes), you were told that you are supposed to obey all LAWFUL orders, but if you know an order to be unlawful (they order you to wash their car or something that isn't in your job description, or against regs), then you not only have the right to refuse to follow it, but you have the duty to report it as well.

You weren't ever in the military, were you?

Not up to the military member to decide if the CIC is eligible or not. If they are elected by the country and sworn in, they are eligible as far as the military is concerned. Not the military's job to vet the incoming president. That is the job of the people who elect him and the election boards who are tasked with vetting him.

But, if a military member DID have problems with the CIC, I'm pretty sure there are procedures to address it. I know there are procedures for redress when it comes to the CO mistreating his crew.

The Uniform Code of Military Justice is preeminent of civilian law in strictly military matters.

Military law and civilian law are two totally different judicial systems. If you are charged with a crime that is strictly a military matter, a civilian court has no say in how the military conducts the courts martial.

However..............in the military, you ARE subject to double jeopardy, which is something that a civilian never has to worry about. If you are stopped out in the civilian community for DUI for example, not only will the civilian courts charge and punish you for DUI, but when you get back to the command, they will file charges against you for DUI as well, and handle it under the UCMJ.

Kind of, but not really. If you are just talking among yourselves in the shop and don't make it public, you can pretty much talk about things. However, if you are going to be in a place where it is public and everyone will see what you are saying and doing, you have to check with the PAO first, to make sure that it's not going to be something that will bring discredit to the service you're in, because unfortunately, if a person is standing on the street with a protest or political sign wearing a uniform, people will think that is the official position of that service.

You can voice your opinion but they can fuck you over if they don't like what you say or where you say it. It's arbitrary as hell.

Yeah.............but he also said this (from your link)............

Another document brought forward in an earlier proceeding revealed that Stein posted on a Marine meteorology and oceanographic Facebook page March 23, "As an active Marine I say, 'Screw Obama' and I will not follow orders from him."

Now, yes, he did insult the president, but more importantly is that his chain of command saw this post and became concerned. What he was doing is against the good order and discipline of the U.S. Military when he said he wouldn't do his job.

And.........in the military, if you post or say something publicly, making it known what your service branch is, you MUST check with the PAO first, because public comments and protests where your service is known could be taken as an endorsement from that service. Same reason you can't go to partisan political rallies in uniform, it constitutes an unofficial endorsement from the service for that candidate.
