-Three months ago, she shot an innocent unarmed black man in his own apartment, mistaking him for an intruder who broke into her apartment
-Claims to have fired warning shots, and felt her life was in danger
-Took a few weeks for Dallas Police to fire her
-Manslaughter charges upgraded to murder charges

Do you think its fair or unfair she has been indicted for murder? Also, does being indicted for murder mean being charged with murder? So now she has to either plead guilty or not guilty and take it to trial?

Of course it's fair. She killed an innocent man. She broke into his house without being invited, pulled out her gun and killed him in his home for no reason at all.

Why wouldn't it be fair?

I have not seen the evidence. And I am not claiming that the only reason she has been charged is because the victim is black.

I asked the question partly to tease you. But also to see your response. How someone loses tells a lot. Good response.
 
This situation reminds me of the season three opener of Blue Bloods when a cop accidently shoots an innocent person. At the end of the episode that cop was going to shoot himself, but Frank was able to give him some things to think about. Sadly it was never said what ended up happening to the cop. I don't know about this woman's story of course, but when something like this is truly an accident, what is to be done with the person who is still here?

"A" mistake is waking up from a sound sleep and knowing that no one else is supposed to be in your home, shooting an "intruder" whom you can't clearly see in the darkness only to then discover that the person you shot is actually a family member who you forgot you gave a key.

In Guyger's case however this wasn't just "a" mistake, it was a series of mistakes. She alleges
  1. She parked on the wrong floor
  2. She walked up to the wrong apartment because she was on the wrong floor
  3. She didn't notice the red welcome mat that would have signified that she was at the wrong apartment
  4. She attempted to unlock the door but the door wouldn't unlock (original version of her story)
    At this point most people would have looked around, noticed the red mat, the number on the door or some other signifier that she was in the wrong place
  5. She put her [non-working because it was not the right] key in the door which caused the door to push open (revised version of her story)
  6. She sees someone inside of what she believes is her residence
  7. Instead of calling for backup (or 911) like we're told to do she enters the apartment, starts giving orders and then shoots what she claims she thought was an intruder
There were several points along this series of events where had she stopped and exercised even the minimum amount of logic or thinking that the death of Botham Jean could have been avoided. She was mistaken about everything that led her up to shooting him, however her shooting of him was a deliberate act. She did not accidently shoot him, she intentionally shot him although for allegely the wrong reasons.

I'll readily admit that when I first heard this story my initial response in addition to the dismay over Jean's death was concern for the officer as to why she was so exhausted as to cause confusion of this magnitude. I myself have gotten off on the wrong floor of my apartment building, walked up to the door that in my mind was mine, put my key in the lock and only noticed that something was wrong, when my key wouldn't open the door. At that point, I first looked around at my environment which looked familiar but slightly off, then looked directly at the number on the door and realized I was on the wrong floor. I was very embarassed and hoped that the occupant hadn't heard me put the key in the lock or that they weren't peeking out at me through the peephole. I immediately got the heck out of there.

It was only more than a month thereafter that I began reading and watching YouTube videos from people around the country weighing in on the incident that I found out that the police exercised a search warrant for Jean's apartment (he's the victim, why wasn't a search warrant issued for her home?), and that Guyger had apparently lodged at least one noise complaint against Jean. That alone signifies enough of a motive for her to confront him to me and it also would explain her insistence while pounding on his door as reported by the neighbors of "open up, open up!" or 'let me in, let me in!". No one who thought an intruder was in their home would be shouting at the intruder to let them in or to open up their own door, in my opinion.
 
It’s a rarity when police officers are afforded the same criminal justice process as the rest of us. When it does happen... It’s a result of the system trying to distance itself from that officers actions, and the subsequent fallout.
Still it’s nice to see once in a while. Things would go more smoothly for everyone involved if there were no two tier justice system...

Often times “yes”. A conclusion juries will often arrive at. Let the people decide. Not the department.
...this cop is being charged-she obviously was wrong..the victim was NOT committing a crime
..the police were NOT called for assistance/etc
....MOST of the other shootings involve a criminal committing a crime and/or resisting/threat/armed/etc
Remember, she was off duty though. This was not an officer involved shooting.
