If the case before the judge is distinguishable from the VA Supreme Court decision, then the judge is not bound by the Supreme Court decision. I saw precious little in the Fox News article about the justification for the judge's ruling. Perhaps he felt that the case before him was distinguishable for some reason which Fox News failed to mention.
