Can Justices On The Supreme Court Phone It In????

I think it requires a full blown impeachment for congress to impose a rule of conduct on SCOTUS and other common law nations like the UK, Ireland and Australia make decisions that can get incorporated into US law like the charging statement of the British isles is how we got the Miranda ruling. Australia's supremes permit something like this because half of the population live in the Melbourne-Sidney corridor and the state supremes have to act as the federal appeals courts and an interstate problem gets real complicated fast due to logistics. Canada also has similar problems. this may just be the way low population density common law nations operate.

Supreme Court rejects Trump's asylum ban in 5-4 ruling as Chief Justice Roberts sides with liberal judges

Chief Justice John Roberts, a conservative judge who was appointed by Republican President George W. Bush, voted with the court's four liberals. Justice Ruth Bader Ginsberg, one of the courts liberal judges, also voted before the 85-year-old jurist underwent a pulmonary lobectomy at Memorial Sloan Kettering Cancer Center in New York City to remove cancerous growths from her lung.

But where did she vote from? NY or physically present in the court?

.
Who cares where she voted from?

I do, otherwise I wouldn't have asked the question. Consistency in government is necessary, if a congresscritter can't phone it in, why should a judge?

.
Wow- perhaps if Congress were different from the Supreme Court- maybe different rules would apply?

Here is the thing- the rules of the Supreme Court are probably online somewhere- but the hell if I am going to go look them up because you are too lazy to do so yourself.

Swell. So she didn't hear the arguments, just phoned in her "I hate Trump phone call. What a waste of space on that court.
Phones have a receiver so you can hear whats being said. They even have conference phones so you dont have to hold the phone up to your ear.
And if that woman had her job in her hospital bed with her, when she should be more concerned with her health, family, and prognosis (more so than any job or materialism that she won't be taking with her on her journey out of here), then she is crazy as a bat. How desperate was that on her part ??

Even if she hadn't voted it wouldn't much matter. The result would have been a tie. It would then get kicked back to the lower court, or the previous judgment would have held...

Ginsberg voted today on the decision to knock down Trumps policy on asylum seekers who enter the country unlawfully. I'm curious how she participated from her hospital bed? I can't find anything online.

Thoughts?
It's not a vote, per se.

The Justices get briefs on the cases they accept and then have their clerks research the pertinent laws that may or may not apply. They then provide this information to the Justice they clerk for and then the Justice writes up their own particular ruling that is either an overturning of the case or a rejection of the case.

However, all this is done ahead of the release of the verdict and each Justice has their conclusion read into the findings.

the arguments have been debated for a while now AND you ever hear of teleconferencing or skype?

Thomas’ incompetent bitchass didn’t ask a single question on a case for 16 years. Ginsburg is fine.

Its 2018 right now. What does the 1800's have to do with your OP?

So why would a congressman have to be physically present?

.
You didnt answer my question. What does the 1800's have to do with your OP?

You didn't answer mine either, plus you provided no link to support your assertion in your first post. You opinion is worthless.

.
I did answer your question. I gave you several ways the judge could have voted.

No, you provided no evidence a judge can vote absentee. It wouldn't have mattered in this case, but it could effect future decisions.

.

i can only find that she ruled b4 having her surgery... there is nothing that suggests it was 'absentee' meaning she was in the hospital or even at home. however if she was 'working' from home.... like i said, teleconferencing is a very effective tool. so is skype.

It will be interesting to see what happens next. Even if she is to survive, she will be considerably weakened by her fall and recent surgery. When you're 85, every health setback is something from which you don't easily recover anymore.

I wish her the best personally, although I could not be more opposed to her rulings or politics. But God will take her when He's ready to take her--her life is even more important than the next political decision or whatever. Life is sacred.

Haven't found a thing that addresses this question, absence of a quorum was as close as I came. It takes 6 to constitute a quorum.

It was portrayed as a 5-4 vote, my question is must a judge be present to vote?

The question isn't what's effective, the question is can it be utilized? I don't understand the aversion to learning something. It was just a simple question and I'd like to know the answer. With the advancing ages of several of the judges, I just want to know how it will work if an illness strikes that keeps them from the bench.

Rare, very rare indeed for an 85 year old to recover from TWO cancer lumps on her lung......personally, I think she passed a few years ago, they stuffed her like a teddy bear, carry her in like they did in "A weekend at Bernie's," and have been having her law clerks write her decidions.....Got to use a can or 2 of Febreze on her daily, or she would be a sure giveaway!
