But the lawyers are starting to get worried. That's why in so many cases Trump wanted to bring, they had DOJ lawyers quit, instead of prosecute the case.

An enterprising legal defense fund (i.e. anti-Trump PAC) could finance a court case.

It's way better to actually let this go to trial (where the DOJ will lose anyways) but on the road there the defense would have this thing call "discovery". Meaning as part of their defense they:
  • Could show the shoddy workmanship,
  • Get details of the no bid contract,
  • Get discovery corresondence (documents, emails, texts, etc.) on how the no bid contract was awarded initially,
  • Get discovery corresondence (documents, emails, texts, etc.) on how the no bid contract ballooned by a factor of 10 (from $1.4 million to cover $14 million with a 20% profit guarentee)
  • Etc.

Normally, the Contractor who did the job would be responsible for fixing it.

But Trump saved his buddy by declaring it vandalism without any evidence.

So the taxpayer will pay another 16 million to fix it

In the past the DOJ was about arresting and prosecuting criminals.

Not anymore, the DOJ is about "investigating", harrassing, making people pay for attorneys, jumping through legal hoops. That is the punishment.

IDK. For as long as I can recall it has been illegal to actually enter the reflecting pool's water. Whether or not sticking your hand in it is entering I guess will be up to the judge. BTW that thing has always been nasty nasty nasty. Repainting the lining can't fix the natural funk of it. Obama letting them connect it to the tidal basin to circulate in "fresh water" didn't do it any favors either.

David Hearn, 67, on Monday denied allegations that he damaged government property by reaching into the waters of the Reflecting Pool to see what it felt like. His attorney also argued that federal authorities have no legal basis for the two misdemeanor citations issued after his arrest.


“There’s no basis for this. We’re going to contest it vigorously,” said Hearn’s attorney, Norm Eisen, who sat alongside him in an interview on MS NOW. “It’s not a federal crime to touch water.”

He declared it but can't prove it. He said there would be pictures, none yet. Then he said they'll show up in court, not likely. What he didn't mention was video. He said someone slashed a 350 foot long cut at night. That place probably has some surveillance cameras and they won't show someone walking through the pool that long.

Now if someone walked through that pool you would think that one of the security forces would have noticed. There's nothing in the news about an investigation into how the security people let this happen because it didnt' happen.
