He did meet the elements of treason. He still had several chances to turn himself in and present his case to a jury of his peers. He chose to try and kill even more Americans. A president would be derelict of their duties not to use all necessary means to neutralize him.

There is a huge demand for non government approved recreational drugs in America. There is no demand for Suicide Bombers or pilots to fly planes into our buildings full of people. More Americans die from pharmaceuticals than imports.
