The NDA itself is perfectly legal.

The methods used to pay for the NDA were illegal. The NDA and how it was paid are two different things.

Trump could have done it leagally:

• Cohen negotiates the deal.
• Trump take $130,000 from his personal account.
• Trump makes the funds available to Cohen.
• Cohen executes the NDA and Trump and Daniels sign it.

That way Trump would have paid for the NDA directly out of personal funds. But they didn't. Cohen committed campaign fraud with the illegal loan, Trump ran the repayment through his business enitity to launder the money and hide Cohen's crime.
