What is heirs’ property? A huge contributor to Black land loss you might not have heard of.​

Untold numbers of Black Americans became landowners following the Civil War when the government handed over some 20 million acres, mostly in the South, under the Homestead Act. Three years later, Union General William Sherman promised formerly enslaved people “40 acres and a mule.” (President Andrew Johnson rescinded that, though.) By 1920, Black families owned 14 percent of all farmland in the U.S., a figure that’s fallen to less than 2 percent today.

Heirs’ property played no small part in this loss. The first generation of Black landowners who died in the early 20th century often left their property to children and spouses through informal transfers. Those parcels continued changing hands, often with the original landowner’s name still listed on the deed, which made proving ownership increasingly difficult as the years went on.

Much of the land loss has occurred since 1961, when the Kennedy Administration established a USDA loan program to assist farmers. The program was administered by locally elected authorities who often denied loans to disenfranchised Black farmers, particularly if they could not prove ownership. (They also granted far more generous terms to white farmers.) Even now, folks who can’t prove ownership are denied farming loans, foreclosure protection, and disaster relief. Predatory developers can use legislative loopholes like the Torrens Act to buy one heir’s interest and force land sales in court.

Advocates are working to right a major injustice that has implications for both landowners and the climate.

The issues that create and are caused by heirs’ property are inextricably tied to race. Accordingly, heirs’ property disproportionately impacts lower- wealth African Americans, particularly in the Black Belt South, which includes many northern Florida counties.

Despite the grand myth that black economic progress began or accelerated with the passage of the civil rights laws and “war on poverty” programs of the 1960s, the cold fact is that the poverty rate among blacks fell from 87 percent in 1940 to 47 percent by 1960. This was before any of those programs began.

Over the next 20 years, the poverty rate among blacks fell another 18 percentage points, compared to the 40-point drop in the previous 20 years. This was the continuation of a previous economic trend, at a slower rate of progress, not the economic grand deliverance proclaimed by liberals and self-serving black “leaders.”

Nearly a hundred years of the supposed “legacy of slavery” found most black children [78%] being raised in two-parent families in 1960. But thirty years after the liberal welfare state found the great majority of black children being raised by a single parent [66%].

Libby you really really don't know what you're talking about and the premise you base it on is garbage. The number of parents in the house has nothing to do with this. The civil rights movement began long before King. Without those black leaders, there would have been no drop because no pressure would have been applied to white leaders. The laws during the 60's did indeed help.

Between 1940 and 1970 there was a 57 percent drop in black poverty and a corresponding 40 percent drop in white poverty. And with all this great dropping, in 1970 black family poverty was 32.2 percent, while poverty for white families was 8.1 percent. That is approximately 4 times the white poverty rate.

In 2020, the poverty rate for all American families was 9.5 percent. Poverty for black families was 17.4 percent, and for white families it was 8.2 percent. Despite increases in educational attainment and breakthroughs at every level of American society, in 2020, black family poverty remained two times that of white families.

At no time from 1940 through 2020 did whites and blacks come close to having equal income. It has not mattered whether America was practicing segregation. It has not mattered that blacks have become better educated. It has not mattered if black households were traditional two parent, two cars, a dog, two children having, good church-going members of American society. Black median income has never risen above 61 percent of what whites have made.

Black men and black women earn less than their white counterparts even when all other factors are the same. So a black 2 parent family will earn less than a white 2 parent family and in fact:

Libby, you need to stop thinking you can tell me about black issues. I'm black. I study them in more detail than you. The black single parent argument was debunked almost immediately after Moynihan wrote his opinion.
