In view of the dangers to which hospitals may be exposed by being close to military objectives, it is recommended that such hospitals be situated as far as possible from such objectives.


Article 19​

The protection to which civilian hospitals are entitled shall not cease unless they are used to commit, outside their humanitarian duties, acts harmful to the enemy. Protection may, however, cease only after due warning has been given, naming, in all appropriate cases, a reasonable time limit, and after such warning has remained unheeded.

The fact that sick or wounded members of the armed forces are nursed in these hospitals, or the presence of small arms and ammunition taken from such combatants which have not yet been handed to the proper service, shall not be considered to be acts harmful to the enemy.

  • Second Additional Protocol (1977) (Article 11): Applies in non-international conflicts (civil wars) and mandates the same protections for medical facilities.

4. Under no circumstances shall medical units be used in an attempt to shield military objectives from attack. Whenever possible, the Parties to the conflict shall ensure that medical units are so sited that attacks against military objectives do not imperil their safety.

Protection may, however, cease only after a warning has been given setting, whenever appropriate, a reasonable time-limit, and after such warning has remained unheeded.
 

Rome Statute of the ICC (War Crime)

Under Article 8(2)(b)(ix) of the Rome Statute, intentionally attacking hospitals or medical units is a war crime in international conflicts. Similar protections exist for non-international conflicts under Article 8(2)(e)(iv).

Israeli troops killed 15 Palestinian medics and buried them in a mass grave, UN says​

Palestinians held funerals Monday for 15 medics and emergency responders killed by Israeli troops in southern Gaza, after their bodies and mangled ambulances were found buried in an impromptu mass grave, apparently plowed over by Israeli military bulldozers.

The Palestinian Red Crescent says the slain workers and their vehicles were clearly marked as medical and humanitarian personnel and accused Israeli troops of killing them “in cold blood.” The Israeli military says its troops opened fire on vehicles that approached them “suspiciously” without identification.

The dead included eight Red Crescent workers, six members of Gaza’s Civil Defense emergency unit and a staffer from UNRWA, the U.N.’s agency for Palestinians. The International Red Cross/Red Crescent said it was the deadliest attack on its personnel in eight years.

Since the war in Gaza began 18 months ago, Israel has killed more than 100 Civil Defense workers and more than 1,000 health workers, according to the U.N.

IOF militia admitted its crime.

Maybe if Hamas had observed the Geneva Convention on October 7, 2023, a few people might actually give-a-$hit. :itsok:
 
Has anyone seen a formal response by the IDF? With Hamas' record of false reporting, that would be worthwhile. Does the IDF have reliable information that the incident was not what it appeared to be?

THere are a few facts and factors that the MSM has long ago decided to ignore, and they are:

  • If Hamas were to surrender and lay down their arms, the carnage would stop immediately.
  • Hamas continues to hold innocent hostages...it is not even denied. In exchange for their hostages, illegally taken, they demand the release of hundreds of known and incarcerated criminals.
Hence, the statements above that Hamas is responsible for all of these deaths are logical and valid.

Yep. Same old same old. Hamas militants hiding in ambulances.
