Actually according to the constitution. If a winner can't be determined (getting to 270) then the house determines the president, and the senate determines the VP.

If the house (due to things like kicking the speaker out of office) can't get their act together and choose a president, then the chosen VP, becomes acting president.

The sitting president will assume the power to prevent a handover of power regardless of the assumed winner. There will be too much peril in declaring Kamala the winner when the guns have been brought out.
