Unions - I used to work for labor labor lawyers and they fought these battles all the time. In this particular case, I can see both sides of the argument, but still ... alcohol and/or drugs on the job could lead to "accidentally" costing some poor soul his or her life.

I hate this This is such a dilemma for me... As a rational person, I have to say the pot smoker needs to be punished for his illegal behavior.
It was very unwise for him to be sparking up in a State owned vehicle while he was on duty performing his job... While the judge may have the flexibility of getting his job back, I don't believe it would be right...
I have smoked a boat load of pot in my life, but I have been very discreet when I did smoke. I won't lie and say I never smoked while I was on the job. The majority of my smoking was done in the confines of my humble abode. I no longer smoke because of the fact the Pot comes through the hands of some very nasty people anymore. I am contemplating taking a vaca and going to Denver for a few days and getting stoned...

that isn't why the court gave the employee his job back. the judges were not morons. the judges were following the law which is this:

it was simply about the standard for review....not an approval of the act of the employee. while i understand you want to rail against our judicial system when you don't like the results, the job of the court isn't always to make sure that a particular result occurs in a particular case. it's to make certain that the standards set by the law are followed.

you might not like the result but it was probably a correct decision. (hence it being a unanimous decision).

You are in your 40s , heck knowing you, I would buy you a quarter ounce , let you smoke it on the job because after you smoked it, I know you would be good to go to get the job done.

Okay. So the University said the guy should be fired, his union said given the fact he had a good record otherwise, he should be placed on probation and put on a testing program. An Arbiter and the Judges felt he should get a second chance.

This is what happens when you actually give workers rights. WOW. Amazing.

When I worked painting with a buddy smoking pot made the time fly. Every two hours "break", smoke a half dubie then back to work.

I'll be honest I have a white collar sales job now. I don't like getting high at lunch then chatting with the president or a customer face to face at 1pm. If it's good weed I'm not the sharpest tool in the shed for a couple hours.

But give me a chainsaw I'll be fine
