Problem with legality in this modern age is that it's not always desirable within the modern system. Checks and balances are out of whack.

I think the arguments against invoking title 10 are more compelling than the arguments I've heard in Trump's favor. I think Newsom will win the lawsuit. Hell, Trump has lost 96% of all the some 200 lawsuits against him since he took office.

He was told the guard was nationalized. Orders went to Newsom, and then the feds take over.
