We are now in a Constitutional crisis. The makings of which are Federal judges, almost all Clinton, Obama, or Biden appointees, with a few Trump appointees but only by the necessity of where they are seated.

Yes, this is a Constitutional crisis.

Where is John Roberts? The times den a strong Chief Justice not a wishy-washy one whose wife loves the fancy parties in Washington, D.C. The times need a Rehnquist, a real Chief Justice, which we sadly are lacking.

Lincoln tried to deport all the Blacks

The United States of America founded the African country of Liberia and sent shiploads of free blacks to it, Hati & other countries to get them out of the USA before & during our US civil war to free the slaves.

This is why the US constitution was ratified at the conclusion of that US civil war war to not allow the deportation of anyone born in the USA or any US citizen.

So Trump can't deport the "Anchor Babies" by his Executive Order. To change the US Constitution, it must be ratified by three-fourths of the States (38 of 50 States).

Maybe Trump should try going by the Rule of Law and the Constitution of the United States, he swore to protect and defend.

If the parents abandon their child, then we'll take care of it. The parents have no right to stay, both would be illegal immigrants. They are welcome to take their offspring with them. The argument will be moot when anchor babies are ruled citizens of the parent's native country.

You must be talking of some Amendment eh not the entire Constitution

His Article 2 authority trumps their district courts' "inferior" authority.


Yep, no lower courts created by, and subject to elimination by, Congress can be coequal with the Article II power.

This is the biggest 'miss' in America for decades now, but maybe many are waking up to this fact.

Congress CANNOT create something equal to the Constitutional powers of Article II. Only SCOTUS is coequal.

Trump hasn't deported any alleged anchor babies.

And the thought that an Amendment, meant to give citizenship to freed slaves, now includes any child popped out in the USA is absurd, particularly a child of someone in the nation illegally.

I can see, if SCOTUS rules they are citizens, shiploads from Asia full of pregnant women entering our territorial waters to give birth to "citizens".

SCOTUS making such a ruling, and it is over. Probably what you people want.

The Suspension Clause of the U.S. Constitution, found in Article I, Section 9, Clause 2, prohibits the suspension of habeas corpus except when in cases of rebellion or invasion, the public safety requires it. This clause specifically limits the power of Congress to suspend this writ, according to the Congress.gov.

He shouldn't have to tell them that--- put another way, they have to already know that (but don't care).

To be clear:
  • A president is elected by the collective wills of many tens of millions of people supporting whatever his platform is.
  • A district court judge is not only elected by no one, but his opinion and position is that of exactly ONE person--- HIS.
  • To make matters worse, there are 670 of these judges.
So, you see, the wheels of Congress turn slowly, but either they and/or the SCOTUS MUST respond to this situation and resolve it because if they don't, elections will be meaningless. Unless someone puts their foot down, from here on out, there will be district court judges somewhere to interdict themselves into /every/ presidential policy and action.
