It is important to remember that "all" have what they call "elements of the offense."
The
elements of a
crime are a series of components which must be present in order for it to be demonstrated that someone is guilty of a
crime. In the case of the crime of "Apartheid," the elements are not merely "separation, discrimination, and domination." There is more to it than that; including the "racial" component --- "one racial group over any other."
Almost all occupations have some form of "separation, discrimination, and domination." All borders and demarcations have an element of "separation." Even political policies have a practical application for separation plans: "

The "Discrimination" aspect is an action that denies social participation or human rights to categories of people based on prejudice. In the case of the Palestinians, social participation is controlled on the basis of the threat the Palestinians represent if left unrestrained; a matter of record and the history of past criminal behaviors associated with Palestinians. All criminal containment has a measure of "domination" associated with it.
