Now, if the will had divided the estate as per Sharia, then the court would have upheld the will. Would you have considered that enforcing Sharia?

The main point is that the Brother was arguing that Sudanese precedent applied because they were all from there, and that made a contract between all of them, which is of course silly.

However, I could see that if all parties contractually agreed to follow Sudanese Sharia, then the US court would enforce it under American Contract law, not Sharia.

This wasn't the case here. It appears the Brother wanted to prove that Sharia law applied because they were all Sudanese Muslims, and of course he lost because Minnesota law is supreme in this situation.

If a sharia law happens to be the same as one of ours, it's just a coincidence. Never, ever should it be favored over our laws. For instance, we don't allow women to be beaten for disobedience. In Muslim countries, the law says the men can beat their wives. Here, it's called domestic abuse, not a right. Those who practice sharia shouldn't even be allowed in this country.
