Despite the left's trying to scare people with claims that Trump will be coming for them next...this is an issue that the American people agree on. By almost 80/20 they want criminal illegals removed from the country. They don't want to have MS13 gang members in their cities and towns. They understand the danger. The Democrats don't care. Actually, while illegal immigrants have limited constitutional rights here, the 5th and 14th Amendments specifically apply to Garcia, as established by Zadvydas v. Davis (2001) and Reno v. Flores (1993).

The text of the 5th Amendment explicitly states, "No person" meaning anyone in the US, legal or illegal.

The government is asserting a right to stash away residents of this country in foreign prisons without the semblance of due process that is the foundation of our constitutional order. Further, it claims in essence that because it has rid itself of custody that there is nothing that can be done. This should be shocking not only to judges, but to the intuitive sense of liberty that Americans far removed from courthouses still hold dear.

I contend the executive branch is actually usurping the authority of the judiciary to be the judge of whether Garcia and his fellow deportees deserved to be sent to El Salvador. The regime is trying to bypass one of the three branches of government and consolidate power for itself. It believes it has the power to send those people to a foreign gulag, most likely for the rest of their lives, without judicial review. This is trump's domestic policy solution for removing alleged gang members. Not foreign policy towards El Salvador.

Remember, even the enemy combatants sent to Guantanamo were given the opportunity to have a judicial process weigh in on their fate.

Which is in total a mistake. Foreigners do not deserve ANY amount of legal process. They’re sub-human trash. They’re lower than even our homeless population. They should not have any ability to access the judicial system.
