The US census is in the constitution, and the US Census counts illegal aliens among the population.


The resident population counts include all people (citizens and noncitizens) who are living in the United States at the time of the census.

Romans counted everyone too, even those who weren't Roman citizens. But those who weren't citizens had virtually no representation, very few rights, and could be nailed to a cross at whim.

Not necessarily. They can consider the impact of their decision on the well-being of the nation (as they see it). The libs on the SCOTUS do that all the time.
