Transportation Department workers with 'exceptional' reviews told they're fired for 'performance' issues​


Letters went out to dozens of probationary employees in at least one section of the Department of Transportation that said part of the reason they were being fired was for poor performance, according to a copy of the letter obtained by NBC News.

But as a source familiar and a secondary document viewed by NBC News laid out, most of those employees were rated as being “exceptional” performers by their supervisors.


This means Orange Jezzzus has learned from experience after pushback by unions it's easier to fire competent staff if you just lie about their performance.

Trump is relying on hand picked Federal judges and a servile majority in the Supreme Court.


Firing employees en masse with the same claim of poor performance is illegal, said Jim Eisenmann, a partner at the Alden Law Group, a law firm specializing in litigation by federal employees. It violates federal law covering career civil service employees, he said.

“It can’t be true,” Eisenmann said. “They’re clearly not articulating this on an individual basis, which is what makes it so suspect.”
 
Your link just says that they cut jobs. Doesn’t say any vital functions were prevented by those cuts.

I guess they didn’t cut any of the “vital” fish and wildlife employees.

The exchange let me to check out their website and find out about their fish stocking program. But there’s no link for if I want to have my pond stocked up. Do you have to know someone to get fish from the federal government? Do you have to be a preferred minority, or something?

All kidding aside, odanny illustrates why this argument is so difficult. We talk past each other. The ODanny’s of the world care about people losing their job. To him and others it is self evident that people should get good paying jobs from the government and always keep them no matter what.

We the taxpayers wonder why we are paying people to have jobs just for the sake of having jobs. Oh, Danny is perplexed that it is not self evident.

Conservation Is Hoarding

Its mission is to keep valuable resources out of circulation. The resultant artificial scarcities will raise prices and make the rich richer. Nature is a crime against humanity; only mindless and primitive propaganda influences us to worship it.
 
National Parks are going to be trashed this summer, I wonder how many Fish and Game have been terminated? Both were understaffed already, especially the Forest Service.
Here’s a thought….. people using the NPS need to respect it and keep it clean. Protests for George Floyd, illegal immigrants, and pro-Hamas resulted in the National Mall in DC getting trashed.

Mistakes, miscommunication and confusion


The firings started Thursday, by email and on video calls, after the Trump administration held calls with agency heads ordering them to terminate most probationary and temporary employees. The dismissals picked up pace into the weekend, hitting thousands more at the Interior Department, the Department of Health and Human Services and the Energy Department.

Some employees said the proceedings seemed rushed, the details botched. Termination letters at Education listed the wrong job, or the wrong start date. A legal help number offered in a notice sent to a Small Business Administration employee led to the voicemail for an apartment building, not a lawyer. Some firing letters seemed copy-pasted from a form and left out the name of the agency where employees worked.


The Friday email to agencies from OPM only caused more confusion. The email at first directed agencies to finish all their firings by close of business Monday, a federal holiday. Agency leaders were supposed to send a spreadsheet listing all their terminated probationary employees to OPM chief of staff Amanda Scales by 8 p.m. that day, the email said. OPM later adjusted the deadline.

The “tracker” should include “which probationary employees have been terminated and which you plan to keep,” the email said. “For those you plan to keep, provide an explanation of why.”

OPM also offered a template notice agencies could send to fired workers. It read in part: “The Agency finds, based on your performance, that you have not demonstrated that your further employment at the Agency would be in the public interest.” Federal law gives agencies wide latitude to fire probationary workers so long as they provide written notice “as to why he is being separated [and] the agency’s conclusions as to the inadequacies of his performance or conduct.”

That is pretty comical. These fired federal employees, they don't do any work, most of them stay at home and telecommute, right? And yet now you are so delusional that you think they are going to show up to raise field crops. They ain't going to do it, damn few Americans are going to work those fields.

And delusional is certainly the right word. Those that claim, like you, that these immigrants are taking jobs from Americans, are both delusional and ignorant. Ignorant as to what those jobs are really like. And nothing exemplifies that reality better than immigrants working the fields, it is so much more than picking the crops.

Field cropping is some hard ass work. And dangerous, I mean fishing boat in Alaska dangerous. And these commercial farms, this ain't working the summer at the grandparents, my experience from a young age. One a dairy farmer, the other field crops. It was hard work, but hell, I pretty much was just showing up at harvest time. The real work is setting the crop in, pruning it, maintaining it until harvest.

And the really comical part, the money. Oh, these immigrants are suppressing wages. I am here to tell you, those immigrants bring home more money than almost any blue-collar worker, rather paid hourly or even salary. At least they do around here. Sure, much of the time it is for cash under the table. But they work longer, and harder, than most. And among the immigrant community, the field workers are held in high esteem.

I have seen it. For the immigrant, and yes, probably illegal, overstaying a tourist visa granted to visit relatives. It starts in a single wide trailer, with no walls, except for maybe the bathrooms, two of them. It is wall to wall cots, a maximum-security prison probably gives you more personal space. The cooking is done outside, communal, and it is more than a dozen men staying there.

But they work. They show up at the crack of dawn, and they dig it until mid-afternoon. Then, they show up at another gig, maybe just a busboy, but they dig some more. And they do this day in and day out, sometimes weeks at a time. But when they take off, well they show up at the finest restaurants, dressed to the nines, wife and kids along.
