Yes but the ruling was also that actions taken AS President can't be used as evidence. So it depends on how much evidence was things done while he was still President. The things were being moved while he was still President. That means the actual theft is inadmissible as evidence. That's how he'll likely get away with it. Because under the SCOTUS ruling, the prosecution wont be allowed to show evidence that Trump, while still President, ordered his staff to help him steal the documents.
