President-elect Donald Trump on Monday confirmed he would declare a national emergency to carry out his campaign promise of mass deportations of migrants living in the U.S. without legal permission.

Overnight, Trump responded to a social media post from Judicial Watch's Tom Fitton, who said earlier this month there are reports the incoming administration is preparing such a declaration and to use "military assets" to deport the migrants.

"TRUE!!!" Trump wrote.

Trump pledged to get started on mass deportations as soon as he enters office.

Sec. 333. Interference with State and Federal law

The President, by using the militia or the armed forces, or both, or by any other means,
shall take such measures as he considers necessary to suppress, in a State, any
insurrection, domestic violence, unlawful combination, or conspiracy, if it--

(1) so hinders the execution of the laws of that State, and of the United States
within the State, that any part or class of its people is deprived of a right, privilege,
immunity, or protection named in the Constitution and secured by law, and the
constituted authorities of that State are unable, fail, or refuse to protect that right,
privilege, or immunity, or to give that protection; or

(2) opposes or obstructs the execution of the laws of the United States or impedes
the course of justice under those laws.

In any situation covered by clause (1), the State shall be considered to have denied the
equal protection of the laws secured by the Constitution.​

 
1. Can the President Use the Military to Respond to Domestic Unrest?

Yes, but this is subject to certain, critical legal restrictions under the Posse Comitatus Act and the Insurrection Act. The president is, of course, the commander-in-chief of the Armed Forces (and the D.C. National Guard), but he lacks the authority to use the military in any manner that he pleases. That authority is constrained by Congress and the courts and further informed by military instructions and doctrine.

Under the 1878 Posse Comitatus Act, Congress has limited the president’s ability to use the federal (title 10) military in domestic law enforcement operations such as searches, seizures, and arrests. A criminal statute, the Posse Comitatus Act makes it unlawful for the Army or Air Force to “execute the laws … except in cases and under circumstances expressly authorized by the Constitution or Act of Congress.” So, as a general matter the president cannot simply call in federal military forces or nationalize state National Guard units to quell domestic civil disturbances in Minneapolis or elsewhere without pointing to a Posse Comitatus Act exception. ( I am not sure he will be able to according to this. Military is not allowed to enforce laws. from what I read here.)

ACLU files lawsuit seeking details on Trump’s plan for mass deportation​


Civil-liberties lawyers alarmed by President-elect Donald Trump’s plan to launch mass deportations of undocumented immigrants sued the federal government Monday for information about how authorities might quickly remove people from the United States.

The federal lawsuit alleges that U.S. Immigration and Customs Enforcement has failed to respond to requests for basic information about its existing contracts with private airline companies that make up “ICE Air,” as well as ground transportation services, airfields and policies governing deportation flights, including those carrying children.

Lawyers said the information is urgent because of Trump’s election victory this month and his upcoming inauguration on Jan. 20. Advocates for immigrants have accused ICE and its contractors of treating migrants harshly and holding them in inhumane conditions.


It has already been challenged.
 
He should use every tool at his disposal to get shed of those that Biden/Harris let in illegally.

That was one of the two main things that Trump was rehired for.

Now if that takes riding roughshod over the evil dems to do it, then so be it.

The dems can't shop for judges if he declares a national emergency.
