If by "turned away at the border" you mean "arrested within 100 miles of the border and deported, regardless of how long they were here" then sure.
And their hearing usually involved a border agent, not a judge.

Ordinary law abiding illegals get TEN DAYS to contest their deportation. That is also the law. It's in the US Code.

Just because they get a hearing, doesn't mean they won't be deported. All immigration judges in this country report to the Attorney General, and can be overruled by the Attorney General. This is part of Due Process. The Attorney General is in charge, not the administrative judges (who are nothing but lawyers with too much time on their hands).

Indeed, it appears that in order to be counted as a "border removal" by ICE, it suffices only that a non-citizen be arrested by a Customs and Border Protection officer at a border crossing or by the Border Patrol within 100 miles of a land or sea border.
