If so, they would have declared the act unconstitutional......duh....they haven't.

They had that right and ACLU claimed they only had 12 hours time to do it. Scotus ruled it wasn't enough time and it should be longer, without saying how much time, also they said no more of this Mickey mouse judge shopping bullshit as this all should happen in the district where they have been jailed.

This was a temporary ruling.

Trump using AEA without court intervention hasn't been decided as of yet.
