Because the Executive Branch isn’t allowed to pick and choose which laws to uphold and which laws to protect. They are required to enforce the law. Hillary Clinton broke the law. James Comey was required to open an investigation. He was also required to recommend prosecution, but because he’s a left-wing asshole, he recommended against prosecution and the corrupt Obama Administration would never prosecute one of their own.
