There are procedures for being in possession of classified material. The only problem with indicting Trump back in January is that he could avoid prosecution based on their inability to prove criminal intent. They would have to prove Trump knew classified documents were in those boxes.
And it's tough to prove somebody knew something. Should have known, doesn't count,
