It is so stated, in 5 USC 3161, that he has the authority to form, by an executive order, a temporary organization or committee designed to perform a specific project or study for no less than three years or terminates upon completing the project or study. As head of DOGE, the temporary organization, he has the right to appoint anyone he wants to help him run it.

(a)Definition of Temporary Organization.—For the purposes of this subchapter, the term “temporary organization” means a commission, committee, board, or other organization that—

(2)is terminated upon the completion of the study or project or upon the occurrence of a condition related to the completion of the study or project.

(b)Employment Authority.—

(1)Notwithstanding the provisions of chapter 51 of this title, the head of a temporary organization may appoint persons to positions of employment in a temporary organization in such numbers and with such skills as are necessary for the performance of the functions required of a temporary organization.
(2)The period of an appointment under paragraph (1) may not exceed three years, except that under regulations prescribed by the Office of Personnel Management the period of appointment may be extended for up to an additional two years.
(3)The positions of employment in a temporary organization are in the excepted service of the civil service.

And BEFORE one intervenes - a REPORT needs to be presented, containing FACTS, and not just unproven assumptions - whilst his appointed apprentice babbles about maybe being wrong in his assessments.

I don't think DOGE is doing anything to fire people or dissolve agencies.

From my knowledge of how the law works, they have to report their findings to the president, who then acts on that information. Trump is dissolving and firing. Not DOGE.

Within the regulatory and legal confines of the laws, of course. If the rules state fed employees can not be fired without cause, or an agency was created by law by congress, or the congress requires 30 days notice, or the laws stipulate how any changes can be done etc etc etc, then the president has to follow the legal rules and regulations to do such....

An approval from a judge would not be needed if the president follow the rules and regulations and laws set forth....
