The reason Pence doesn't set that policy is because neither #1 or #2 of the executive branch are involved in legal interpretations of the Constitution and States' Powers. That belongs to the USSC. However, I'll bet Pence will have some say and weight as an advisor to Trump on the selections in coming months on filling vacancy (s) in that branch of government.
