What really happen:
Depape and PP were ongoing lovers. That night at the ghey bar, the two picked up a third for a fudge packing threesome.
Later that night, once at the Pelosi home, the gheyness was getting out of hand. Depape got jelly he was not getting enough attention and started acting silly.

Not necessarily. They might just decide Mr. DePape is nuts and locked him away in a lunatic asylum. Or perhaps Mr. Pelosi might refuse to press charges or testify in the case- making a conviction impossible.
