Background Concerns over laws regarding rape and sexual misconduct, as well as the repeal of
the Don’t Ask Don’t Tell policy led to a review of the Uniform Code of Military Justice. The Joint
Service Committee of Military Justice recommended numerous changes to the Uniform Code of
Military Justice concerning rape and sexual assault. These changes were submitted to the House
and Senate Armed Services Committees for consideration. Included in these recommendations
was language that would repeal the prohibition on sodomy.18

With the Supreme Court having struck down anti-sodomy laws nationwide in 2003, a subsequent military court of appeals decision in 2004, and the repeal of Don’t Ask Don’t Tell in 2010, Article 125 is almost unenforceable, as long as sexual relations don’t run afoul of other military regulations like prohibitions on officers sleeping with enlisted personnel. Technically, the language also criminalizes “unnatural” consensual sexual contact for heterosexual service members as well, but it criminalizes any sexual contact for gay and lesbian service members.


It wasn't when Warbler served. He was subject to it. Just because it wasn't pursued didn't mean it was legal.

I'm sure Warbler called all of his un married shipmates "dishonorable" for giving or receiving oral sex. :rolleyes:
