Technically YOU are correct, it was not a Supreme Court ruling, because they never took up the case.
BUT, it was a Supreme Court decision, via the vote of the SC Justices, NOT to take up Powell's appeal, send it back to the circuit/appeals court and use their ruling as FINAL.
