Let me start with a little anecdote about music and movie piracy cases. Back in the early 2000's, large music labels started filing lawsuits against people that allegedly pirated their music. The music labels (copyright trolls) would file cases against thousands of defendants (does) at a time. This caused total chaos because it caused the courtrooms to be packed full and the docket for just one case to be massive. The judges were fed up with this so they limited the amount of does per case.

After this, the copyright trolls started filing many duplicate cases. Literally just copy/paste complaints and the main goal was to extort money from the does. There would end up being hundreds of these cases. Judges were getting fed up again and magistrate judges started dismissing them en mass. And this was well deserved because the copyright trolls are scumbags.

Now apply this to the ballot eligibility case against Trump. Can you imagine if the Supreme Court decided kicking Trump off the Colorado ballot was legal? There would end up being hundreds of these lawsuits for every single election. It would just create more chaos and make the government even less efficient than it already is.

There needs to be more checks and balances put in place to curb the ridiculous legal warfare going on right now.

First, let me tell you I basically agree with the spirit of the OP.

Having said that purely by the legal rational on the conservative side I have questions.

The whole point of at least 5 of the Justices is to just judge on what's in the Constitution. It was the whole rational for overturning Roe.

"Abortion is not mentioned in the Constitution so the Supreme Court should leave it up to States." At no point did they say, "well it would create a patchwork of bad faith laws and therefore we should step in."

As I see it. The Liberal justices are consistent. The Conservative ones are hypocrites in how they apply legal standards.

Checks and balances?

Proportional Representation has more checks and balances. You have more political parties, therefore more oversight. More choice for voters, therefore more opportunities to punish the political parties where it matters.

Right now for voters, they can't punish a party they kind of prefer without gifting everything to the party they hate. How dumb is that?

Trump is being prosecuted because he's running for office. Even the most liberal pundits agree with that now. Biden is running so he can avoid being prosecuted. 4 more years for Biden will take him to the last 1% of his life, so he could really care less what happens to him at that point. Trumps "crimes" are like jaywalking vs armed robbery for Biden's crimes.

The point is to discourage a political culture in which filing harassing lawsuits is the standard course of things. There used to be more parties, however politicians / lawyers will weasel their way out of anything if it isn't airtight.

Thing is, PR leads to better politicians.

In the US you don't need to stand for anything. Just go for a primary for the Reps or Dems, and spend money making yourself look good and you might win.

With PR people look at the parties and what they stand for. Which means as a politicians you need to actually think about what your party stands for, and convince people it's right.

Also it's easier to punish political parties.

The AfD in Germany was formed in 2013. By 2017 they got 12.6% of the vote and 90 seats in the Bundestag. That was 7% more than the previous election. The CDU/CSU lost 5% of the vote.

The CDU/CSU is Merkel's party who were in government. They were still in government after, but they could see there was a problem with their message. The people wanted to punish them, and they could.

In the UK, UKIP, a similar type of party to the AfD, were formed in the 1990s. The UK uses FPTP like the US does. By 2015 they'd got 12.6% of the vote, the same as the AfD. And yet they got only one seat because the FPTP system decided this was so. The Tories in the UK did not get punished.

This lack of punishment means the politicians feel safer, it's easier to keep bad politicians etc.
