If we are going to punish employers for not knowing someone is illegal, which I don't agree with by the way, we need to at least define what lengths they can go to in determining such a thing on the basis of their judgement and assumptions. Because, if we can't establish this beforehand, it leaves the employer subject to all sorts of lawsuits for violating rights to privacy or just plain racial discrimination.
