That isn't what the Supreme Court said. They said it was a legislative issue. They did not relegate this only to the states. It's why McConnell noted a Federal ban was possible.

They said it was not a Constitutional privacy issue.

Well, they might try, but the lack of constitutional authority the court applied to itself would also apply to congress. I don't think a federal ban would be upheld by the court, it's a State issue.
