This decision is United States v. Hemani, issued on June 18, 2026. The Court held that the federal government cannot constitutionally prosecute Ali Hemani under 18 U.S.C. 922(g)(3) the federal law that prohibits an "unlawful user" of a controlled substance from possessing a firearm based solely on his admitted marijuana use.


I'm not really sure what I think about this one. 😐

The "Mah Weed" crowd should be pleased.

LOL....I guess the Paul-Bots finally got what they wanted. ;)

I guess SCOTUS thought the same given it was a 9-0 decision.

Also have to consider its legality in some States and the overall trend of legalization ongoing.

I would stick to felony convictions leading to losing the RKBA.
 
Or a felon in possession. Dealing over a certain amount of MJ is still a felony in most states.

I think any felony should lead to revocation of the RKBA and the voting franchise, with pathways to restore both available up to a certain level of crime.

Rapists and Murders can lose both for life for all I care.

I know what to think about it…

It’s absolutely the wrong decision, top to bottom. As a gun owner myself, I don’t allow alcohol or drugs (including weed and tobacco) in my home. Guns do not mix with drugs and alcohol. If I’m carrying, I’m not drinking. Even if I’m out t dinner. NO Exceptions.

Carrying a gun and being high are just not an acceptable mix. Ever.

Crack Head's problem is that he made a false statement about drug use on the required form.

But the question the form asked is in support of a law which has been overturned. If it doesn't matter whether you're using illegal drugs to own a gun, then it follows that the question is illegal.
 
The ruling just issued by the Supreme Court says illegal drug users can own and possess firearms. So the law convicting Hunter Biden illegally buying a gun while being a drug user, has now been overturned.

The ruling deals with casual users not addicts like Hunter

Nor does it allow people to lie on forms like Hunter did

It’s actually kind of a weasely decision. They didn’t overturn the law. It was a super narrow decision.
