Why do you think drug addicts should get access to firearms?

There is nothing in the post quoted that would indicate that the poster thinks this decision is good for society in general.

OTOH, I don't believe for a second that addicts and drug users are deterred from obtain weapons by a law which says they're not supposed to own guns. In fact, these are the people most likely to be the ones to flout this law, because they need weapons to feel safe when dealing with drug dealers and users.

Even worse for society, many drugs have paranoia and delusions as side effects of their addiction, and the notion that it's now easier for these people to obtain weapons, is cringe worthy, to say the least.

However, this whole "he lied on his gun permit application" still doesn't hold water. If the 5th Amendment to the Constitution gives you the right not to incriminate yourself by answering a government question, the only way for the applicant to tell the truth on this form, is to incriminate themselves.

I had to ship a package to Alaska. One of the state specific laws on shipments was the question "Does this package contain explosives?". Who is going to answer "Yes" to this question, even if you are shipping explosives?

Thats good. You cant ban drug users from buying guns.

But this does not overturn Hunter's conviction. It wasn't weed in his case.

It’s absolutely the wrong decision, top to bottom. As a gun owner myself, I don’t allow alcohol or drugs (including weed and tobacco) in my home. Guns do not mix with drugs and alcohol. If I’m carrying, I’m not drinking. Even if I’m out t dinner. NO Exceptions.

Carrying a gun and being high are just not an acceptable mix. Ever.
I lean the same way but then again I don't drink or smoke the weed so I'm a poor one to ask.

There's a law in the USA saying that felons are not allowed to possess guns. That law seems to be working well. :oops:
 
But the question the form asked is in support of a law which has been overturned. If it doesn't matter whether you're using illegal drugs to own a gun, then it follows that the question is illegal.

He had a 5th amendment right not to incriminate himself. He didn’t have to fill out the form. Once he started he waived that right and swore to them the truth on the form

The Court held that the federal government cannot constitutionally prosecute Ali Hemani under 18 U.S.C. 922(g)(3) the federal law that prohibits an "unlawful user" of a controlled substance from possessing a firearm based solely on his admitted marijuana use.

I hope you are not an attorney, the Fifth Amendment protects you from being compelled to give self-incriminating testimony, but filling out a gun permit application is voluntary: nothing forces you to apply. If a question on the form would require an incriminating answer, like admitting a prior felony, you can decline to answer it, but the result is that your application gets denied or rejected, not that you’re prosecuted for staying silent.

What the Fifth Amendment does not protect is lying on the form. If you answer falsely instead of leaving it blank or refusing, that’s a separate crime, a false statement in connection with acquiring a firearm, and courts have consistently held that the Fifth Amendment doesn’t give you a right to lie — only a right not to be forced to incriminate yourself truthfully.
