Sandwich Guy Found Not Guilty

Sounds like something the democrats would do anyway--for crying out loud, the moron lost his sandwich. It wasn't worth the money and effort to bother with. SMH. I've seen more mature activity in a first grade dodgeball game.

Personally, I believe that an assault charge requires some injury to the alleged victim.

Because the thrown sandwich (even if stale as ****) couldn’t actually have caused any injury, the behavior was not even an attempted assault. Juvenile? Yep. Ineffective? Yep.

But an assault? I don’t buy it.

The statute does not define “assault” directly — so courts interpret it according to federal common law. Under federal precedent (e.g., United States v. Chestaro, 197 F.3d 600, 605–06 (2d Cir. 1999)), “assault” under § 111 generally means:

  1. A willful attempt or threat to inflict injury upon another person, coupled with an apparent present ability to do so, or
  2. Any intentional display of force such as would give the victim reasonable apprehension of immediate bodily harm.
How ridiculous.
You do know that if a child points a 'finger gun' at someone they can be charged with attempted murder.

I loved Judge Joe. I remember watching an episode where the plaintiff who was pissed off by the judge's decision threw an empty paper cup at the defendant, and Judge Joe had her taken into custody and tried for contempt of court.

The man who slung a sandwich at a federal agent in Washington, D.C., and was unwittingly transformed into an opposition symbol of President Trump’s local crime crackdown has been found not guilty of misdemeanor assault after a trial.

A jury handed down the not guilty verdict Thursday against Sean Dunn, a former Department of Justice (DOJ) employee who hurled the hoagie after confronting a group of officers patrolling a popular nightlife area of the nation’s capital.


The acquittal marks an embarrassing loss for federal prosecutors, who pursued the misdemeanor charge after a grand jury refused to return an indictment on the felony assault count they initially sought.

U.S. District Judge Carl Nichols, the Trump appointed judge overseeing the case, said he expected the trial to last no more than two days and called it “the simplest case in the world.”

But the trial dragged on three days, and the jury deliberated for part of both Wednesday and Thursday before Dunn was ultim
ately acquitted.

I suspect the full weight of whatever government is in control would be brought to bear.

She will never live this down. I would give 3 to 1 odds that she's going to be just sitting in a restaurant somewhere someday, or maybe even at the family Thanksgiving dinner, or wherever, and somebody is going to toss a sandwich at her.
