No, in fact he
refused to surrender to the Marshals serving the arrest warrant. He didn't surrender until three days into the incident.
The warrant for his arrest was due to his failure to appear. He knew he was required to be in court and he blew it off; his choice. Well, choices have consequences, and his consequences proved to be dire. Had Weaver surrendered, his son wouldn't have been killed. His wife wouldn't have been killed. But his refusal to surrender set in motion a series of events which resulted in the deaths of his family members...
The FBI started the shooting, killing his wife who was just holding the door open.

Yeah, that sucks. But given the fact that the Weaver's were armed and engaged in hostilities towards authorities, it's not surprising. You know, she could've surrendered, as well, but chose not to.
