Agreed, a president does have the right to take classified documents. That said, a FORMER president does not have the right to keep classified documents. For national security purposes, they belong to the federal government, not a former president.

As far as why Biden is not being charged ... again, his investigation is still underway. Trump was not charged until that investigation collected enough evidence to support an indictment. Because these investigations are not available to the public, I can't tell you how far along the investigation into Biden's mishandling of classified documents is. Another real difference, not a double standard, is that Trump is a former president and subject to criminal indictments. Biden, as the current president, may not be. The Department of Justice has a long standing policy of not bringing criminal charges against the sitting president.
