Maybe, in all my years, I have never seen one hold up, but they weren’t challenged that often either.

Thst has nothing to do with it.

We are talking about limiting employees ability to move to a better position. If one wants to walk off the job and move to a better one that is their god given entitled right.

Not true at all.
Regular employees are virtually never required to sign a non compete.
The stats given are absurd and dramatically exaggerated, there is no way in hell 1 in 5 American workers have to sign a non compete.
It isn't even 10% of that.
Non competes are given overwhelmingly to sales staff and higher executives and that is it.

If you have earned your employees loyalty

Why would you demand a non-compete?

That goes for both sides, and I have seen where employees are loyal to their employers.
