It does have some discussion about whether a record is classified as presidential or non-presidential. In this case, the tapes were deemed non-presidential records akin to diaries.

There's nothing in this case about security classification or declassification.

The court's main point in this case is that Tom Fitton can't force the Archivist to get into a fight with Clinton about whether the tapes belonged in the archives or were personal, which seems pretty obvious.

Check the espionage law under which he was charged.

It has to do with refusing to return national defense information. Nothing to do with giving it to a foreign power. The cited law has to do with refusing to return it to the rightful owner - The United States Givernment.

The Presidential Records Act does not allow an ex-president to take national defense records as his personal property.

As a matter of fact it very clearly says official records are re property of the government and are to be turned over to the National Archivist at three end of a presidential term.

And personal documents aren't for the library, dipshit. The Archives runs the library so if they wanted the documents for the library, they wouldn't make them personal.
