Obama tries to stop Texas execution

"WASHINGTON — The Obama administration took the unusual step Friday of asking the Supreme Court to stop Texas from executing a Mexican citizen convicted of raping and killing a 16-year-old girl.

The administration said the court should delay the planned July 7 execution of Humberto Leal for up to six months to give Congress time to consider legislation that would directly affect Leal's case.

The 38-year-old native of Monterrey wasn't told he could contact the Mexican Consulate after his arrest in the murder of Adria Sauceda. His lawyers say police violated an international treaty by not telling Leal he could have consular assistance.

Legislation pending in the Senate would allow federal courts to review cases of condemned foreign nationals to determine if the lack of consular help made a significant difference in the outcome of their cases. Last week, a federal judge refused to delay the execution.

The Supreme Court has previously ruled that states can't be forced to comply with the provisions of treaties without some intervening federal legislation."

I am not sure the Feds can stop it. A Federal court cannot stay a State court. Looks like another trip and fall for the Obama administration and a chance for Perry to give Obama the finger.

Therefore its about the rights Americans will have when they are in another country. No big thing to CON$ who hate Americans and love executions.

Wonder if any one actually has a clue when they are talking about the faulty forensics of Texas. That was in Harris County.

He had his appeals. And none of them found evidence of faulty forensics or miscue of Justice. The Federal Government will have to actually provide evidence he was denied due process. And that never happened in all the appeals. Been 17 years.

If the Court takes it, they will probably find no material consequences to his not contacting the Consulate.
His appeal was denied.

Furthermore the DNA evidence from one minute drop of blood found on his underwear was not retested. Mind you that none of her blood was found on his shirt, pants, boots or socks he had on, nor in his car. He was not at the party while the girl was being raped by the white Texans, none of whom were even investigated or questioned, but he showed up after the rape and was furious at the party goers for allowing the gang rape to happen!

Even the Texas Court of Criminal Appeals that denied his appeal wrote in 2009, “[W]ith the science available at the time of trial in 1994, no one could credibly say that an unknown blood sample came from a given individual.”

Did you know that in Mexico your family has to provide your food if you are in prison. If no one brings food, then you must rely on the charity of your fellow inmates for food. Some country's can beat a confession out of you or imprison you for no reason. I point to the hikers in Iran. Think there rights are being looked after ?

Other states are trying to abolish the death penalty … my state’s puttin’ in an express lane.

That's what happens when the US no longer honors the Vienna Convention, this was not the first, no other country will honor it either.

You are indeed an ignorant one. that's not an insult, just a fact. The Geneva convention does not cover Americans traveling abroad. You are a hate filled liberal, and it must be bad if you would take the side of a rapist of any race or nationality.
 
This SOB should never have gotten a trial. He's not an American citizen. The rights of American citizens to counsel, trial, etc.... DO NOT APPLY TO HIM. They should have executed his ass 30 seconds after they caught him.

Again, according to all the witnesses, Leal arrived at the party AFTER the gang rape. You are obviously a hate filled CON$ervative who defends white rapists and blames their rape on foreigners that you hate no matter how much evidence exists that foreigners you hate didn't do the raping.

If it is a treaty, doesn't that apply to "legal" citizens, not those that are in another country "illegally" (we could just punish him like the Central or South American countries do for illegal entry and save ourselves the cost of a trial?

From the way it reads Obama did not want to prevent the man's execution, the administration merely wanted it to wait on laws. How are things going to 'change' within the system if 'we' do not accommodate the ways through which the system works?

Treaties are the law of the LAND.

The states do not get to parce out what parts of a treaty they like.
