well actually HC isn't a Constitutional Right....nowhere in the document does it say we have a right to it. It is a Common law legal principal we brought over from England. The only time it's mentioned in the Constitution is when it can be suspended, and in fact specifically talks about it being a priilege not a right

Article I, Section 9, Clause 2:

The Privilege of the Writ of Habeas Corpus shall not be suspended, unless when in Cases of Rebellion or Invasion the public Safety may require it.
