You fundamentally misunderstand the issue, as did the judges. When expression of love for one's country is speech that is deemed controversial on school property, then elevating an orderly environment over a patriotic culture is the wrong way to go. Some speech on school grounds can be disorderly and it's right to restrict that speech in order to defuse tensions and return to educating the children. Celebrating one's patriotism SHOULD never be considered disruptive speech. If disruption does arise, then the school needs to address and correct the students who find such speech offensive and make this corrective action a lesson for all other students. Patriotism is a higher value than an orderly school environment. That's where the 9th erred - they're liberals and their values are all screwed up.
Yup, being patriotic is considered offensive by the far lefties. They tolerate things from people who are hostile to us and I wonder how many left radicals share the hatred of America that many other enemies do.
In this case, the disruption comes from Hispanic students who dislike Americans and threaten to beat kids up if they wear patriotic clothing or display flags on their bicycles. It's the bullies that present the problem, yet the solution is designed to appease them. If this were the other way around and Hispanics wearing flag t-shirts were threatened, the bullying students would be sent to re-education classes to teach them about tolerance.
Instead of addressing the ones making these threats, the school officials chose to limit the freedom of expression for the American students. It's the same method the administration applies to radical Muslims. Don't get mad at them for making death threats, beheading people and plotting attacks, just stop upsetting them. It's insane.
Schools, like many liberal politicians, don't have the same rules for all students. Some are given preferential treatment. Hispanics are allowed to fly flags and celebrate Cinco de Mayo. the bias rules allows some students to enjoy freedoms denied to others.
At a college, some sorority members were in trouble because they had a Mexican themed party where they wore sombreros and ate tacos. They were accused of racism. Schools are following the liberal platform. Preach about equality and the U.S. being a melting pot, then favor some groups over others and keep people separated by blaming them for participating in various cultural activities. The message is that tacos and sombreros are a Mexican thing and you've no right to partake. Wouldn't want people sharing or getting along, so keep throwing around accusations of racism whenever someone steps out of line. Of course, the rules are different depending on the color of your skin, so it would be nice if they sent us all a list of rules for our race so we can dutifully obey.
Groups, like La Raza and other radicals, often have a hand in shit like this. Some believe that the Hispanics have more right to be here and, therefore, don't have to respect us and yet they can do what they want. Liberal politicians and judges are often sympathetic to them and will twist the laws to advance their beliefs.
