With biden and pence, While they did have documents, There is no evidence that they knowingly stole them while leaving office. While in office they had the legal right to have them would not be the 1st people to hold office in this country. Who mistakenly cap documents.

With trump on the other hand, Many of these documents are known to have been in the White House. Up to the day he was leaving and he took them when he no longer had the right Even look at them let alone possess them. He then lied about having them when asked to return them, And pressured his own attorneys into making false statements to federal courts claiming that he had turned all documents over even though he had not. And that is the reason why they decided to file charges. The fact that he knowingly and intentionally attempted to avoid returning the documents and made false statements under oath in the form of sworn affidavits that proved to be false. I doubt charges would have been filed if he had simply returned the documents the 1st time the national archives had asked him to and told him that he had taken. Them by mistake. If he had done that the national archives would have Never even requested f b I intervention.

The FBI wasn't For well over a year. The national archives Had been requesting these documents be returned since early 2021. And trump continuously lied to them claiming that he did not have any documents classified or otherwise, Which they knew was not true and so they were the ones who decided to ask the f b I to intervene with a search warrant. If he had simply returned the documents to the national archives, That will have been the end of it. Charges are rarely filed in cases like this, Unless there is evidence as there is in this case, That there are overt actions being made to prevent the documents from being returned.
