Majority Rule: The Thermonuclear Option

Eliminating the filibuster in the U.S. Senate to permit legislation to pass by a simple majority is sometimes called “the nuclear option.” That is insufficient. If you’re really interested in ending the tyranny of the minority, go for the thermonuclear option.

The plan assumes a Democratic President and a unified Democratic majority in both the House and Senate, with members willing to sacrifice their own seats as necessary.

Start with the Democratic Senate packing an expanded U.S. Supreme Court with new members nominated by the President who will interpret the U.S. Constitution to allow Congress to expel states from the Union. It doesn’t matter if that is the “wrong” interpretation. There is no higher court to overrule their decision. Congress then expels all states except for those with Democratic governors and legislatures, which presumably would also have a majority Democratic representation in Congress.

The new, much smaller Congress then proposes constitutional amendments that would replace the electoral college with a popular vote and eliminate the Senate, leaving only a House whose representation is based solely on population; and provides for Congress (the House of Representatives) to draw all congressional districts, determine voter eligibility and other rules for the election of members of Congress and the President and Vice President.

All powers previously reserved to the Senate would be conferred to the House.

It worked in 1994 with Clinton's tax hike and his Assault Weapons Ban.

The Republican-dominated states can simply agree to majority rule, rejoin the Union, and exercise the political power justified by the number of people who vote Republican.

Thing is it's just the type of thing you should be very aware of as it touches every corner of the country.

If I had the skills and was bent on nation-wide disruption the EBT system would be the first thing I would shut down.

Hey, from what I hear at least folks could get them some frozen king crab legs for a change instead of the EBT crowd snatching them all up. ;)

Except the republican states wouldn’t do that. They would form their own country, close their borders and operate the way the Constitution requires. Very quickly their economies would boom with practically every industry moving out of the People’s Republic of America into the new country to avoid all the burdensome regulations and sky high taxes. The People’s Republic would quickly go broke trying to pay “free” benefits with no income. It would be left with two choices; launch a war of conquest against the new country which would be a losing proposition since most military personnel come from the “red” states, or give up and join the new country after signing binding agreements to honor the constitution.

Presumably, this new “red” country would include both Wyoming and Texas. If the new “red” union retains the original constitution, that means Wyoming, with about 580,000 people, would have the same power in the Senate as Texas with 31 million people. Do you think Texans would be content with their representation being so diluted? Effectively, only 580,000 Texas would have power in the Senate; the votes of the other 30 million or so would count for nothing.

Of course, if you still want to avoid the “tyranny” of the big states, that might be fine with you.
