Louisiana is trying to extradite a New York doctor for allegedly sending abortion medication into the state.

Louisiana Attorney General Liz Murrill signed an extradition form Wednesday for Dr. Margaret Carpenter, less than two weeks after a grand jury indicted the physician for prescribing and sending abortion pills to a woman in the state, Murrill announced in a post on social platform X.


In the post, Murrill states the form has been transferred to Louisiana Gov. Jeff Landry’s office. “We will take any and all legal actions to enforce the criminal laws of this State!” she wrote.

A grand jury in the District Court for the Parish of West Baton Rouge indicted Carpenter, her company Nightingale Medical PC, and another woman who gave the medication to her teenage daughter.

The case is thought to be the first time criminal charges have been issued against a doctor for allegedly prescribing and sending abortion medication across state lines, after the Supreme Court’s Dobbs decision ended the constitutional right to abortion.

The Louisiana lawsuit is also a test of New York state’s shield law, which protects health care providers from out-of-state investigations and prosecutions for prescribing and delivering abortion medication to patients in states with strict abortion laws.


NY response:
New York Gov. Kathy Hochul (D) weighed in on the recent extradition order in place for a New York doctor who allegedly sent abortion medication into Louisiana, calling it a “ripple effect of overturning Roe v. Wade.”

“I will never, ever send this person into harm’s way to stand for 15 years of possible jail time for just being a doctor,” Hochul told MSNBC’s Rachel Maddow during an interview Thursday evening, “And that’s what our country has come to.”

If someone commits a crime in another state, they are now refusing to extradite?

Will they same when their criminals cross state lines and other states refuse to send them back to New York? If Daniel Penny had gone to Louisiana after making bail and refused to come back, would they have thrown a conniption if Louisiana didn't honor extradition?

New York put in place an actual shield law post Dobbs for just this contingency.

Suppose Louisiana passed a shield law now, allowing the state to refuse extradition to other states, say for gun offenses that would be legal there?
 
I would submit: they could in fact do that.

Will be an interesting precedent to cite when the next Kyle Rittenhouse case is brought and the defendant refuses to return to a lib state to face trial.

That definitely occurred in the past. :clap: Its one reason the FBI was started.

I Don't agree with it. The issue is unimportant unless it's a murderer or a kidnapping. That's just pure foolishness.... Louisiana is attempting the type of control that has never been possible in any society at any time. Louisiana can take action against its own citizen I suppose.... I still think they're wasting their time.... But reaching across state lines put something as nebulous as the abortion argument is just not a winning proposition. I say this as a staunch pro-lifer.
