(f) Whoever, being entrusted with or having lawful possession or control of any document, writing, code book, signal book, sketch, photograph, photographic negative, blueprint, plan, map, model, instrument, appliance, note, or information, relating to the national defense, (1) through gross negligence permits the same to be removed from its proper place of custody or delivered to anyone in violation of his trust, or to be lost, stolen, abstracted, or destroyed, or (2) having knowledge that the same has been illegally removed from its proper place of custody or delivered to anyone in violation of its trust, or lost, or stolen, abstracted, or destroyed, and fails to make prompt report of such loss, theft, abstraction, or destruction to his superior officer—
Shall be fined under this title or imprisoned not more than ten years, or both.

Actually, there is a key element missing there. For it to qualify as gross negligence, there needs to be a proven information leak. None of the info was proven "permit(ted) to be removed from its proper place of custody" and Hillary couldn't be proven to "hav(e) knowledge" it was "illegally removed" and failed to report it.

That was one of the biggest points that Director Comey made. The law simply doesn't have the depth to apply to modern operations. The Espionage Act of 1917 hasn't received a single update since 1950. This is over two decades before the first email was ever sent. Quite simply, a subtlety like an "improper email server" is extremely difficult to bend the Act to cover because the very concept of email hadn't been conceived yet. During the Director's hearing, one of the senators even got flustered and asked "What would it take" to allow them to prosecute someone in this situation. Comey told him, "That's between you and the Justice Department." stating that what she did wasn't illegal under the law as written. They would be free to write a law to cover it in the future, but what they have now is insufficient. He went on to state that there would definitely be consequences to anyone still in state service, and that punishment could be anything from suspension, to loss of security clearance, to termination. But there would be no criminal charges. There's a difference between laws and rules.
