He does not cease to be a soldier until he is dishonorably discharged.
And that requires a court martial.
While there is little doubt and plenty of eye witnesses that he deserted, after being adjudicated guilty of desertion it may be that the court exonerates him for findings in extenuation and mitigation.
I do indeed expect him to be ultimately discharged, but it will take a full blown court to decide how and which.
