I get that hypotheticals are uncomfortable. But, of all places, in the Supreme Court, hypotheticals need be explored fully, because the highest court's rulings will apply to an effectively infinite number of situations, not just the one at bar.
But this is what happens when you pick law school students on the basis of group membership, not talent, and graduate them on the basis of DEI stats instead of hard work and success.
